# Terms and Conditions

_Effective date: August 27, 2026_

**By purchasing or accessing the U3DA course or portal, you agree to these Terms — including the withdrawal waiver in Section 5 and the no-refund policy in Section 6.**

## 1. Who We Are

U3DA ("the Course," "the Portal," "we," "us") is a course teaching underwater photogrammetry and 3D reconstruction techniques for divers.

**Seller.** The Course is sold by **Marcin Stempniewicz**, a sole proprietorship (jednoosobowa działalność gospodarcza) registered under Polish law:

Your purchase contract is with the Seller. The Seller is solely responsible for the Course content, its delivery, pricing, and any consumer-protection obligations described below.

**Platform provider.** The U3DA website and member portal run on the CommunitySync platform, technically provided and hosted by **Trusun Media Inc.** ("Platform Provider"), 240 E Palmetto Ave #100, Longwood, FL 32750, United States. The Platform Provider builds and operates the software the Seller uses to run the Course — it is **not a party to your purchase**, does not receive your payment, and has no obligations regarding Course content, delivery, refunds, or any other term of sale. Its role is limited to hosting the Portal and processing personal data on the Seller's behalf, as described in our Privacy Policy.

## 2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase the Course. Use of the Portal is limited to enrolled students in good standing.

## 3. The Course and What's Included

Enrollment gives you access to the video lessons, downloadable materials (including Blender project files and textures where provided), and any community areas included with your plan, for a period of **12 months** from the date of purchase. Course content and structure may be updated or expanded over time; we do not guarantee that any specific lesson or feature will remain unchanged for the full access period, though we will not materially reduce what you paid for without reasonable notice.

## 4. Price and Payment

All prices displayed on the Portal are in euros (€) and **include applicable VAT**. Payment is processed securely by **Stripe**, an independent third-party payment processor, at the time of purchase — the Seller does not see or store your card details. Your contract with the Seller is formed once payment is confirmed.

## 5. Your Right of Withdrawal — and When It Doesn't Apply

As an EU consumer, you ordinarily have the right to withdraw from an online purchase within 14 days, without giving a reason, under Directive 2011/83/EU as implemented in Polish law (Act of 30 May 2014 on Consumer Rights).

**This right does not apply once you have expressly asked for immediate access to digital content and confirmed that you understand you lose the right of withdrawal by doing so** (Art. 16(m) of the Directive; Art. 38(13) of the Polish Consumer Rights Act). Because the Course is digital content delivered immediately upon payment, you are asked to give this confirmation at checkout, before you pay. If you give it, your right of withdrawal ends the moment you are granted access.

If you do **not** give that confirmation, or if access is not granted immediately, your statutory 14-day withdrawal right applies as normal — contact us at underwater3dacademy@gmail.com to exercise it.

## 6. Refund Policy

Once you have confirmed immediate access under Section 5 and been granted access to the Course, **all sales are final and no refunds are given**, except:

- where required by mandatory law (for example, if the Course materials are seriously and
  demonstrably defective and we cannot fix the problem within a reasonable time), or
- where the withdrawal confirmation in Section 5 was not properly captured at checkout, in which
  case your statutory withdrawal right applies.

## 7. License to Course Materials

While your access period is active, you are granted a limited, non-exclusive, non-transferable license to access and use the Course materials for your own personal, non-commercial learning. You may not copy, redistribute, resell, publicly share, or use the video lessons, Blender files, textures, or other materials to teach or train others without our prior written consent. This license ends when your access period expires or your account is terminated.

## 8. User Conduct

You agree to use the Portal only for its intended educational purpose, and not to:

- share your account or course access with anyone else;
- attempt to download, scrape, or redistribute Course content beyond personal use;
- attempt to gain unauthorized access to the Portal or other users' accounts;
- upload or share any content that is unlawful, defamatory, or infringes another person's
  rights.

Violation of these rules may result in suspension or termination of your access without a refund, to the extent permitted by Section 6.

## 9. Intellectual Property

The Course content — video lessons, written materials, Blender files, and associated media — is owned by the Seller or licensed to the Seller, and is protected by copyright. The underlying platform technology is owned by the Platform Provider or its licensors. Nothing in these Terms transfers ownership of any of this to you; Section 7 describes the limited license you receive.

## 10. Disclaimer and Limitation of Liability

The Course is provided for educational purposes. It is not a substitute for proper dive training, certification, or safety instruction from a qualified diving professional, and nothing in the Course should be treated as diving safety advice. You are responsible for your own diving safety and for complying with the training, certification, and equipment requirements of your diving activities.

To the fullest extent permitted by law, the Seller and the Platform Provider disclaim all warranties regarding the Course and the Portal, and their total combined liability arising from your purchase or use of the Course is limited to the amount you paid for it. Nothing in this section limits liability that cannot be excluded under mandatory Polish or EU consumer-protection law, including liability for death or personal injury caused by negligence, or for fraud.

## 11. Complaints

If something is wrong with your order or the Course, contact us first at **underwater3dacademy@gmail.com**, describing the issue. We will respond within **14 days**, as required under Polish consumer-protection rules.

If we cannot resolve a complaint directly, EU consumers may bring the matter to their national consumer-protection body or an out-of-court dispute resolution (ADR) entity recognized in their country — in Poland, the relevant authority is the **President of the Office of Competition and Consumer Protection (UOKiK)**. Nothing here limits your right to bring a claim before the competent court instead.

## 12. Governing Law and Jurisdiction

These Terms are governed by Polish law. If you are a consumer resident in another EU country, this choice of law does not deprive you of any mandatory consumer protections your own country's law gives you.

Before going to court, please contact us under Section 11 and give us a reasonable opportunity to resolve the issue informally. Any dispute that cannot be resolved this way falls under the jurisdiction of the competent Polish courts, without prejudice to any right you have as a consumer to bring proceedings in the courts of your own country of residence.

## 13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated effective date, and we will make reasonable efforts to notify active students by email. Continued use of the Portal after the effective date constitutes acceptance of the revised Terms; changes do not apply retroactively to a purchase already made.

## 14. General Provisions

- **Severability.** If any provision of these Terms is held invalid or unenforceable, the
  remaining provisions remain in full force and effect.
- **Entire agreement.** These Terms, together with the Privacy Policy, constitute the entire
  agreement between you and the Seller regarding the Course and supersede any prior agreements on
  the subject.
- **No waiver.** Failure to enforce any provision of these Terms is not a waiver of the right to
  enforce it later.
